The Applicant Nos.2 to 4 are on bail as submitted by learned Senior Counsel pursuant to the order passed u/s 389 of Cr.P.C. after their conviction and sentence. The Applicants were accused in Sessions Case No.891 of 2023 before the Additional Sessions Judge, Belapur. The Applicant No.1 is in custody. The Applicants were convicted for the offence punishable u/s 493, 494, 495 r/w 34 of the Indian Penal Code. The Applicant No.1 was sentenced to suffer rigorous imprisonment for 7 years and to pay a fine of Rs.5,000/- and in default of payment to suffer rigorous imprisonment for two months. The other accused were sentenced to suffer rigorous imprisonment for two years and to pay a fine of Rs.2,500/- and in default of payment to suffer rigorous imprisonment for one month each.

Learned Senior Counsel submits that even the Applicant No.1 was on bail during trial. Since the first informant is seeking time, I am granting time to her. Learned Advocate on record for the Applicants/Appellants shall add the first informant as a party Respondent in the Appeal as well as in the

3 / 3 application. The amendment shall be carried out forthwith without disclosing her identity. The order of suspension of sentence passed by the Additional Sessions Judge, Belapur, on 08/05/2024 in respect of the Applicant Nos.2 to 4 shall be continued till the next date.
