Mr MG Patil, APP, for the respondent/ State.
API RA Gahile, Arnala Sagari Police Station, Palghar, is present. ---- Coram: R.N. Laddha, J.
Date: 12 December 2024.
P.C.:
By this application, the applicant again seeks modification of the bail condition under clause (d), as imposed by the Coordinate Bench of this Court (Coram: Madhav J. Jamdar, J.) in the order dated 5 March 2024. The relevant operative part
of the order reads as follows:
"(d) The Applicant shall report to the Arnala Sagari Police Station, District-Palghar once a week on each Monday between 11.00 a.m. and 1.00 p.m. until the conclusion of the trial."
2.
Ms Trupti Khamkar, the learned Counsel appearing on behalf of the applicant, submits that the applicant has been granted bail on 5 March 2024, and since then, he has diligently and sincerely adhered to this Court's order. However, complying with the requirement to report to the Arnala Sagari Police Station every Monday poses a challenge. The applicant, a father of three children, is a resident of Delhi, and trying to establish a small business in the city to support his family. The learned Counsel proposes that the applicant be allowed to report to the Arnala Sagari Police Station once a month till the conclusion of the trial, ensuring compliance with the condition. 3.
Mr MG Patil, the learned Additional Public Prosecutor representing the respondent/ State, on instructions, acknowledges that the applicant has duly attended the concerned Police Station, and no grievance has been received against the applicant. He submits that if the Court is inclined to modify the condition, a suitable condition be imposed.
4.
Considering the facts and circumstances of the case, including the fact that no grievance has been received against the applicant, this Court is inclined to allow the present application by deleting the aforesaid condition under clause (d) imposed by order dated 5 March 2024 and modified with the following condition:
The applicant shall attend the Arnala Sagari Police Station on the first Monday of every month between 11:00 a.m. and 2:00 p.m.
till the conclusion of the trial.
5.
The application stands disposed of accordingly. (R.N. Laddha, J.)
