The Applicants were the original accused Nos.27, 28, 29, 33, 38 and 55 in Sessions Case No.51/2023. The learned Additional Sessions Judge, Solapur vide judgment and order dated 27.5.2022 convicted the Applicants and others under Section 332 read with 149 of IPC and under Section 353 read with 149 of IPC. The substantive sentence imposed was one month simple imprisonment apart from imposition of fine. 2.
Learned counsel for the Applicants submitted that the co-accused who have preferred Appeal challenging the Deshmane(PS)

9-i-IA-2287-24.odt same judgment and order are granted bail pending their Appeal. He relied on the order dated 11.6.2024 passed in I.A. No.2145/2024 in Criminal Appeal No.562/2024.

I have considered these submissions. The major sentence is for one month within which period the Appeal is not likely to be decided. Learned APP could not controvert this position.

In this view of the matter, even in this Application the Applicants can be granted bail during pendency of their Appeal. Hence, the following order :
O R D E R
(i) During pendency and final disposal of Criminal Appeal No.605/2024, the Applicants are directed to be released on bail on their executing P.R. bonds in the sum of Rs.30,000/- each (Rupees Thirty Thousand Only) with one or two sureties each in the like amount.
