By this application, the applicant is seeking relaxation of bail condition imposed by this Court (Coram: N.R.Borkar, J.) dated 20.01.2023. 2.

Learned counsel for the applicant submits that by order dated 20.01.2023, this Court in paragraph No. 5 (iii), has directed that "The applicant shall not enter into the limits of Pune District except to attend dates before the trial courts, till conclusion of trial". 3.

It is contention of learned counsel for the applicant that the allegations against the applicant are that he was conspirator to the crime. Since last two years he was not entered into Pune District. His family stays in Pune district hence requested to allow the application. 1/2

Learned APP strongly objected to allow the application on the ground that applicant was the main conspirator to the crime. The offence is registered under Section 120-B, 302 read with 34 of Indian Penal Code is registered against the applicant, hence requested to reject the application. 5.

I have heard both the learned counsel. The role attributed to the applicant is conspirator. He is outside Pune District for two years. His family stays in Pune. The applicant is attending the Court dates regularly. Considering these facts, I pass following order.

ORDER

(a) Condition No. 5 (iii) of the Order dated 20.01.2023 is hereby relaxed.
