This is an application for permission to travel Abroad. The Applicant was convicted by Special Court Pune for offences punishable under Section 7 and 13 of Prevention of Corruption Act, 1988. He was sentenced to suffer rigorous imprisonment for one year and to pay a fine of Rs. 2,000/- and in default to suffer simple imprisonment for one month rigorous imprisonment. Both the sentences were directed to run

2 / 3 concurrently. The Applicant preferred an appeal before this Court. The said Criminal Appeal No.98 of 2013 is already admitted. The Applicant was released on bail vide the order dated 6th February 2013. The prosecution case is that the Applicant accepted bribe of Rs. 2,000/- for clearing of the bills of the complainant who was working as a Surveyor Maintenance in DILR Office at Satara.

Learned counsel for the Applicant submitted that his brother-in-law, who is 70 years of age, is suffering from cancer. The Applicant's sister and the said brother-in-law are living in Stuttgart, Germany. The Applicant is desirous of visiting his ailing brother-in-law and his own sister. The appeal is not likely to be decided in near future. The Applicant is already granted bail. Considering this submission, I am inclined to grant permission to travel abroad.

The Applicant has sought permission to travel abroad between first week of July 2024 to last week of September 2024. Hence, following order:

ORDER

3 / 3 i) The Applicant is permitted to visit Stuttgart, Germany between 1st week of July 2024, to last week of September 2024.

ii) Before leaving India, the Applicant shall give the itinerary of his travel Abroad.

iii) He shall give the contact details and the address where he will stay in Germany to the Investigating Officer. iv) After he returns to India, he shall report to the Investigating Officer.

v) With these directions, the Interim Application is disposed of.
