This is an application for condonation of delay of 36 days in filing the Appeal. The Applicant was the original accused No.6 in Sessions Case No.434/2007 before the Additional Sessions Judge, Pune. The Applicant along with others was convicted under section 307 and other offences and was sentenced to suffer RI for seven years and to pay fine of Rs.1 Lakh.

Learned counsel for the Applicant submitted that due to financial constraints, the Applicant could not contact an Advocate of his choice for about 24 days and delay was caused because of that. After that, the Advocate took about 10 to 12 days more to prepare and file the Appeal. Therefore, there is total delay of 36 days.

Considering these grounds and in the interest of justice, the delay of 36 days in preferring the Appeal is condoned. The Appeal be processed further.
