2) There is a delay of 236 days in preferring the present Application.

3) Learned Advocate for the Applicants on instructions submitted that, for condonation of the said delay in filling the present Application, the Applicant is willing to pay cost of Rs.5,000/- to Kirtikar Law Library, High 1/2

The said statement is accepted as undertaking given to this Court. 4) Subject to payment of cost, delay is condoned and Application is allowed in terms of prayer clauses (a) and (b). 5) It is made clear that, if the said cost of Rs.5,000/- not deposited within stipulated period as noted above, Application shall stand dismissed without further reference to this Court.
