On 23.10.2023, both the Criminal Writ Petitions were dismissed for non-prosecution and hence the present Interim Applications are taken out praying for its restoration. 2.

Heard learned counsel for the Applicants and perused the Interim Applications.

Paragraph Nos.7 to 9 have set out the circumstances in which the Interim Applications are filed and we are satisfied with the bonafides of the Applicants. It being settled position of law that a client should not be made to suffer on behalf of lapse on part of the Advocate, we deem it appropriate to allow both the Interim Applications in terms of prayer clause (b).

List both the Criminal Writ Petition Nos. 386 of 2013 and 393 of 2013 on 01.08.2024.
