Heard learned counsel for the applicant, learned APP for the State and learned counsel for respondent No.2. 2.

By this application, applicant is seeking modification of order dated 22.02.2023 passed by this Court (Coram : M.S.Karnik, J.). While granting bail to the applicant, this Court had directed the applicant to report to the Investigating Officer once in a month on the first Saturday of the month till trial is over.

Learned counsel for the applicant submits that applicant is a lady and it is causing difficult for her to attend every month to the Investigating Officer. Investigation is completed and chargesheet has been filed, hence requested to allow the application. 1/2

Learned APP and learned counsel for respondent No.2 strongly objected to allow the application on the ground that allegations against the applicant are serious, hence requested to reject the application. 5.

I have heard both the learned counsel. The applicant is charged under Section 326, 354-B, 504 of Indian Penal Code read with Section 75, 79 of the Juvenile Justice (Care and Protection of Children) Act, 2015 and Section 12 of Protection of Children from Sexual Offences Act, 2012. Investigation is completed. Chargesheet is filed against the applicant. Considering these facts, I pass following order.

ORDER

(i) Application is partly allowed.

(ii) Condition No.(g) of the order dated 22.02.2023 is relaxed as under:

"Applicant shall appear before the Investigating Officer as and when required."
