By this application, the applicant seeks extension of time to abide by the statement made on behalf of the applicant, as recorded in paragraph No.5 of the order dated 22.12.2023 passed by this Court (Coram: M. S. Karnik, J) in Bail Application No.4134 of 2023. 2.

It is brought to the notice of this Court that as per the contents of paragraph No.5 of the said order, within a period of four months, the applicant was to deposit an amount of 7 lakhs in the trial Court, to show ₹ his bonafides.

It is submitted that upon release on bail in terms of the said order, by PRIYA KAMBLI Date:

2024.07.25 14:19:13 +0530 PRIYA KAMBLI within the aforesaid period of four months, the applicant deposited an 1/2

918_IA_2646_24.doc amount of 2 lakhs in the trial Court. Copy of receipt is annexed at page ₹ No.11 of the application. But, the balance amount of 5 lakhs could not be ₹ deposited in the time period of four months.

Copy of demand draft dated 03.07.2024 is placed on record at page No.13 of the application. It is submitted that the said demand draft of 5 ₹ lakhs is ready for being deposited in the trial Court and for that purpose, this Court may consider extending the time period for the same. 5.

In view of the above, this Court is of the opinion that the prayer made in the present application can be granted.

Accordingly, the application is allowed in terms of prayer clause (a), which reads as follows:

"(a) The Application may be allowed and the Trail be direct to accept the Demand Draft bearing No.008252, Drawn on 03.07.2024, from IDBI Bank, in order dated 22.12.2023, in bail Application No.4134 of 2023, in Crime No.I-0382 of 2022, registered with Arnala Police Station, Palghar for the alleged offence u/s. 406, 420, 506 r/w. 34 of IPC." 7.

The said demand draft be deposited with the trial Court within one week from today.
