Criminal Appeal No. 1540 of 2018 is filed by one Dattatraya Ramchandra Tambde (Accused No.1) alongwith coaccused Sagar Dattatraya Tambde (Accused No.2), being aggrieved by the Judgment and Order dated 29.03.2017, convicting them for the offence punishable under Section 302 read with Section 34 of the Indian Penal Code and having been sentenced to life imprisonment.

Pending the Appeal, present Interim Application is filed by Sagar Dattatraya Tambde, seeking separation of his Appeal as he intend to engage a separate counsel. It is worth to note that Accused Nos.3 and 4 have already filed their Appeals being numbered as Criminal Appeal Nos. 474 of 2017 and 341 of 2017 respectively.

We have heard the learned counsel for the Applicant and perused the Application alongwith Practice Note No.53 issued by this Court on 02.04.2018, we are inclined to grant the Interim Application in terms of prayer clauses (a) to (c).

The Applicant is at liberty to file a separate memo of the Writ Petition.
