The Applicant was the original accused No.2 in Special (MCOC) Case No.11 of 2018 before the Special Judge under MCOC Act, Pune. He was convicted for commission of offence under Section 392 of IPC and under Section 3(1)(ii), 3(2), 3(4) and 3(5) of the MCOC Act.

The major sentence imposed on him was rigorous imprisonment for six years for the offence under Section 392 of IPC. He was also directed to pay fine under each of these heads. He was imposed fine of Rs.25,000/- under Section 392 of IPC and for each head under MCOC, he was imposed fine of Rs.5,00,000/- each. In default sentence of all these sections was three and half years. BGP.

Learned counsel for the Applicant submitted that the Applicant is from poor background. His family could not help in engaging advocate in preferring his Appeal. Therefore, this Application is filed through assistance of Legal Aid Services of this Court. Hence, there is delay of 1 year and 363 days in preferring the Appeal.

Considering these submissions and in the interest of justice, the delay in preferring the Appeal is condoned. 5.
The Appeal be processed further.
