The applicant in Anticipatory Bail Application (st) No. 3233 of 2020, has deposited the amount of Rs. 1.75 Crores in terms of the order passed by this Court dated 09.03.2021 in the said Anticipatory Bail Application. The present Interim Application is filed by the original complainant seeking permission to withdraw the said amount.

912-ia-2714-2024doc Anticipatory Bail Application submits that the Hon'ble Supreme Court has held that such prayer cannot be allowed. In support of it, he has relied upon the order passed by the Hon'ble Supreme Court dated 09.12.2024 in Criminal Appeal Nos. 5118 & 5119 of 2024.

The Hon'ble Supreme Court in the above order has observed that an application for Anticipatory Bail is not a recovery proceeding and therefore the amount cannot be withdrawn by the complainant. The Interim Application therefore cannot be entertained and the same is rejected.
