By this application, the applicant seeks relaxation of condition (g) imposed by this Court (Coram : M. S. Karnik, J.) vide order dated 7 November 2023, in Bail Application No.3474 of 2023. The relevant operative part of the order reads as follows: "(g) Except for attending the trial and for the purpose of reporting to the Investigating Officer, the

Mamta Kale 27-ia-2723-2024 in ba-3474-2023.doc applicant shall not enter the area of Haveli Taluka after being released on bail till the trial concludes." 2.

Mr Parth Shah, the learned Counsel appearing for the applicant, submits that the applicant's family consists of his mother, grandmother and younger brother. The applicant's mother is the sole bread earner of the family. The family now requires the applicant's assistance as the ailing grandmother requires to take appropriate treatment at the hospital. The learned Counsel asserts that the applicant has no criminal antecedents and is only 21 years old. Further, the investigation has concluded, and a charge sheet has been filed; however, to date no charge has been framed.

Mr Amit Palkar, the learned Additional Public Prosecutor representing the respondent / State, does not seriously dispute the applicant's contentions and acknowledges that the investigation is complete, and the charge is yet to be framed. 4.

In the totality of the circumstances, this Court finds it appropriate to delete Condition (g) imposed by this Court (Coram: M. S. Karnik, J.) by order dated 7 November 2023. 5.
