This is a second application filed by the Applicant, seeking suspension of sentence and for release on bail. The learned A.P.P. has invited our attention to an earlier order passed by this Court on 28/02/2022 in Interim Application No.2259 of 2021 in pending Criminal Appeal No.762 of 2021. In paragraphs 6 and 7, this Court has specifically recorded as under :- M.M.Salgaonkar

2/2 17 IA-2740-24.odt "6. Be that as it may, we are not inclined to entertain the application of the Applicant/Appellant for suspension of sentence and enlarging him on bail. At this stage, it may not be desirable to give the detailed reasons since appeal filed by the appellant is pending for hearing. Hence, the interim application stand rejected. 7.

We make it clear that the observations made herein above are prima facie in nature and are confined to the adjuration of this application."

Since a direction was specifically issued that upon receipt of the paper book and record and proceedings, the counsel for the Appellant shall mention the Appeal for early hearing, the present Application do not deserve consideration, though we are keeping the liberty open for the Appellant to act in terms of the order dated 28/02/2022.

The Application stands disposed of.
