By this application, the applicant is seeking relaxation of condition No.(g) imposed by order dated 11th December 2023 passed by this Court (Coram : M. S. Karnik, J.) in aforesaid bail application. By the said condition, the applicant was directed not to enter the jurisdiction of Natepute Police Station, Solapur Rural, after being released on bail, till further orders of the Trial Court..

Learned counsel for the applicant submits that the applicant is SHUBHADA SHANKAR KADAM resident of the Fondashiras, which falls in jurisdiction of Natepute Police Station. The applicant wants to stay with his family. Charge is framed SHUBHADA SHANKAR KADAM Date: 2025.02.04 17:26:26 +0530 against the applicant. Hence, requested to allow the application. 1/2

Learned APP strongly objected to allow the application on the ground that the applicant sexually assaulted the first informant. If the condition is relaxed, he may threaten the prosecution witnesses Hence, requested to reject the application.

I have heard both learned counsel. The first informant, who is a police constable, is posted in Pune. The trial is at Sessions Court at Malshiras. The applicant is resident of Fondshiras, which fall in the jurisdiction of Natepute Police Station. The applicant wants to stay with is family. Charge is framed against the applicant. Considering these facts, I pass following order :
O R D E R
(I) The bail condition mentioned in clause (g) of the order dated 11th December 2023 passed by this Court (Coram : M. S. Karnik, J.)in Bail Application is relaxed.
(II) The applicant shall attend the Trial Court regularly. The interim application stands disposed of.
