Heard, Ms. Khan, learned counsel for the applicant and Mr. Holambe Patil, learned APP for the State.

By this application, the applicant seeks relaxation of condition (d) imposed by this Court (Coram : M.S. Karnik, J.) while granting bail to the applicant by order dated 18.01.2023.

It is submitted by the learned counsel for the applicant that the applicant has scrupulously abided by the said condition and proof of the same is filed in the form of Station Diary Entries at Exhibit "B". It is submitted that the applicant is a young person, who is in the business of Event Management and this Court may consider relaxation of the said condition. Shrikant Malani

The learned APP submits that the Court may pass appropriate orders, considering the fact that the applicant is facing prosecution for offences under NDPS Act.

Having regard to the fact that the applicant for the past about 1 year and 8 Months has abided by the aforesaid condition and charge is yet to be framed before the Competent Court, the said condition can be appropriately modified.

Accordingly, condition (d) is modified to read as follows : "(d) The applicant shall report to the Anti Narcotic Cell, Bandra Unit, on the first date of every alternate month, during the pendency of the trial."

The application is disposed of.
