By this application, the Applicant is seeking relaxation of condition No.(d) passed by this Court (Coram: Prithviraj K. Chavan, J) passed on 7th May, 2024.

Mr. Harsh S. Malhotra, appearing on behalf of the Applicant submits that he will file Vakalatnama during a course of day.

By the said condition, the Applicant is restrained to leave jurisdiction of the Special Court till conclusion of the trial. Learned counsel further submitted that no condition is imposed on other co-accused. The Applicant is ill patient. He is suffering from various ailment, hence, he has to go out the jurisdiction of Special Court. Hence, requested to allow the application.

Learned APP strongly objected to allow the application and he submits that if this Court is going to allow the application, condition be imposed on the Applicant that he shall not take adjournment before the Special Court.

Learned counsel for the Applicant agrees to this statement. 6.

Considering the submissions of both learned counsel, the condition No.(d) imposed on the Applicant is relaxed. The Applicant shall not seek adjournment before the trial Court without any reasonable ground.
