When we expressed our disinclination to entertain the Application filed by the Applicant/Accused No.1, who stand convicted in Sessions Case No.264 of 2013 for the offence punishable under Section 302 of the Indian Penal Code, 1860 and is directed to suffer rigorous imprisonment for life, the learned counsel seek its withdrawal.

He would, however, submit that the Applicant has undergone almost nine years of incarceration and, therefore, his Appeal should be expeditiously heard.

Taking note of the fact that the Applicant is incarcerated for last nine years and since the R & P alongwith paper-book is received, we direct the Appeal to be added to the Final Hearing Board commencing from 30/09/2024, with liberty being given to the counsel to circulate the Appeal for fixing a particular date for final hearing.
