Interim Application No.2857 of 2024 is not on board, taken on board and heard along with the aforesaid writ petition. 2.
Heard learned counsel for the parties.

By this petition, the petitioner seeks re-investigation into the circumstances surrounding the death of the petitioner's daughter. 1/3

Learned counsel for the petitioner states that although the police have filed a charge-sheet as against the accused under Sections 304A, 279, 337 and 338 of the Indian Penal Code, the police have not investigated the angle of a planned murder by the accused in question, which was shown as an accident. She relied on the spot panchanama and the statements of the witnesses, in support of her submission. She further states that although the petitioner's daughter sustained injuries and scummbed to the same, the medical certificate of the accused has not been brought on record nor have the CDR of the accused and the petitioner's daughter examined.

Learned APP seeks time to take instructions with respect to the investigation carried out.

Stand over to 13th August 2024.

The respondent No.3-Superintendent of Police, Alibag, Raigad, is requested to go through the papers and the grievance as set out in the petition.

In the meantime, the trial Court shall not proceed with the case, till the next date.
