Heard Mr Subit Chakrabarti, the learned Counsel appearing on behalf of the applicant, Mr Arfan Sait, the learned Additional Public Prosecutor representing the respondent/State, and Mr Javied Allana, the learned Counsel appearing for the intervenor/informant.

By this application, the applicant has applied for bail in anticipation of arrest in CR No.494 of 2024, registered at Bandra Kurla Complex Police Station, Mumbai, for offences punishable under Sections 406, 409 and 420 read with 120-B of the Indian Penal Code. 3.
Mr Subit Chakrabarti, the learned Counsel appearing on
behalf of the applicant and Mr Javied Allana, the learned Counsel appearing for the intervenor/informant, in unison, submit that the informant and the applicant have resolved their dispute amicably. The informant has received the due amount from the applicant, has no grievance, and expressed his consent to grant pre-arrest bail to the applicant. To this effect, the informant and the applicant have executed consent terms dated 6 August 2024 and placed a copy thereof on record.

After perusing the records, it appears that the genesis of the offence is civil in nature arising out of the sale of the property. The involved parties have now reached a comprehensive settlement regarding their dispute, and the informant consents to granting anticipatory bail to the applicant. The informant, present in the Court and identified by the Investigating Officer, does not object, reaffirms the contents of the consent terms and agrees to grant pre-arrest bail to the applicant.

In light of these circumstances, the application is allowed. In the event, the applicant is arrested in connection with CR No.494 of 2024, registered at Bandra Kurla Complex Police Station, Mumbai, she shall be released on bail upon executing a PR Bond of Rs.25,000/- and furnishing one or more sureties in the like amount.

The application stands disposed of accordingly. As a sequel, the pending application also stands disposed of. (R.N. Laddha, J.)
