Heard learned Advocate for Complainant / Respondent No. 1. The Applications are filed for withdrawal of amount. The Applicants relied upon the submissions recorded in the order dated 10th November 2023. Learned Advocate for Applicant / Accused submitted that the amount is deposited. How much and before which Court is not clarified. The Applicant / Complainant says that it is before the trial Magistrate. Learned Advocate for Applicant / Accused has not accepted the notice that is why private notice is served on the Applicant / Accused. Two separate affidavits are filed. In that view, both the Applications are allowed in terms of prayer clause (a). 2.

The Court of Judicial Magistrate First Court, Ratnagiri to allow the Applicant / Complainant to withdraw amount, if deposited by the Accused, on furnishing undertaking to return the amount if directed by this Court.
