2) By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking temporary bail in Crime No.250 of 2023, registered with Chandan Nagar Police Station, Pune for the offences punishable under Sections 120-B, 409, 419 and 420 read with Section 34 1/3
of the Indian Penal Code, 1860 and Sections 66-C and 66-D of Information Technology Act, 2000.
3) The applicant is suffering from Cancer and bone marrow transplantation is required.
4) The learned APP was directed to call the report from the police as regards the ailments of the applicant. On receiving the instructions, the learned APP has confirmed the fact that the bone marrow transplantation is necessary.
5) Thus, considering the medical treatment that applicant requires and the procedure he has to undergo for bone marrow transplantation, I am of the opinion that the request of the applicant to grant temporary bail for four weeks needs to be allowed.
6) The report of the police submitted to the learned APP is taken on record and it is marked as Article "X" for the purpose of identification. 7) Accordingly, it is directed that the applicant be released on temporary bail in connection with Crime No.250 of 2023, registered with Chandan Nagar Police Station, Pune for the offences punishable under Sections 120-B, 409, 419 and 420 read with Section 34 of the Indian Penal Code, 1860 and Sections 66-C and 66-D of Information Technology Act, 2000, on furnishing P.R. Bond of Rs.25,000/- (Rupees Twenty Five 2/3
Thousand) with one solvent surety in the like amount for four weeks from the date of release of the applicant.
8) The applicant is permitted to furnish provisional cash bail in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) for two weeks in lieu of sureties.
9) The applicant shall report to jail authority where he is imprisoned on 24th September, 2024.
