Heard learned Advocate for Applicant. He has deposited Rs.1,60,000/- (Rupees One Lakh Sixty Thousand only) before the trial Court during pendency of the Appeal. Let him to deposit in all Rs.5,00,000/- (Rupees Five Lakh only). So it comes to Rs.3,40,000/- (Rupees Three Lakh Forty Thousand only).

The earlier amount is withdrawn by the Complainant. This amount can also be withdrawn by him. Hence the order :-

O R D E R

(A) Substantive sentence of imprisonment of Applicant Harvinder Singh Butter awarded by Metropolitan Magistrate, 27th Court, Mumbai in C. C. No. 1958/SS/2015 and confirmed by Additional Sessions Judge, Mumbai in Criminal Appeal No. 697 of 2018 is suspended during the pendency of the Revision on following conditions :- (i) Applicant to furnish P.B. and S.B. of Rs.15,000/-(Rupees Fifteen Thousand only) before the learned trial Magistrate. (ii) Applicant to deposit amount of Rs.3,40,000/- (Rupees Three Lakh Forty Thousand only) within a period of four

(4) weeks from today before the trial Court.

(iii) The Complainant is at liberty to withdraw that amount on furnishing undertaking that he will return the amount, if directed by this Court.

Interim Application is disposed of.
