This is an application for condonation of delay in preferring the Appeal.

The Applicant was convicted by the Sessions Judge, Daman vide his Judgment dated 08.12.2022 passed in Sessions Case No.3 of 2021, under section 376 of the I.P.C. The Applicant was sentenced to suffer R.I. for 10 years and to pay a fine of Rs.2000/- and in default of payment of fine to suffer R.I. for one year. He was also convicted for the offence punishable U/s.506 of the I.P.C. and was sentenced to suffer R.I. for six months and to Digitally signed by VINOD BHASKAR GOKHALE Date:

6-ia-3280-24 pay a fine of Rs.200/- and in default to suffer R.I. for one month. There is a delay of one year and 157 days in preferring this Appeal.

Learned counsel for the applicant submitted that the applicant was not in a financial condition to engage a private advocate for preferring the appeal. Therefore, he sought help of the Legal Services Authority of this Court and with the help of an appointed Advocate, this Appeal is filed. He submitted that, some time was required to get the necessary documents translated from Gujarati to English. This has caused further delay. 4.
Considering these submissions and in the interest of justice, delay of 1 year and 157 days in preferring the appeal is condoned. The Appeal be processed further.
