Heard learned counsel for the Applicant and learned APP for the State.

By this application, the Applicant is seeking relaxation of condition imposed by this Court (Coram: M. S. Karnik, J) by order dated 18th December, 2023.

By the said order, Court has imposed the condition No.(c) on the Applicant that the Applicant shall attend the Investigating Officer of concerned police station, twice a month between 11:00 Shantanu S. Dhudum 1/2

42-IA-3412-2024 IN BA-2408-23.doc a.m. and 1:00 p.m. Learned counsel further submits that investigation is completed and charge sheet has been filed. Applicant is senior citizen and the said condition causing hardship and expenses to the Applicant. Hence, requested to allow the application. 4.

Learned APP submitted that appropriate order be passed. 5.

Considering the submissions of both learned counsel, I pass following order:-

ORDER

i. Application is allowed.

ii. The Condition No.(c) imposed by this Court (Coram: M. S. Karnik, J.) vide order dated 18th December, 2023, is hereby relaxed.

iii. The Applicant shall attend the concerned police station as and when required.
