1) In view of judgment of the Supreme Court in Celestium Financial Versus. A. Gnanasekaran Etc.1, Mr. Shinde, the learned counsel appearing for the Appellant/Applicant, on instructions, seeks leave to withdraw the Leave Application and Appeal, with liberty to file Appeal before the Sessions Court under proviso to Section 372 of the Code of Criminal Procedure, 1973. Reserving the liberty so prayed for, the Appeal is permitted to be withdrawn and disposed of. The Appellant/Applicant shall be entitled to rely on provisions of Section 14 of the Limitation Act, 1963 while computing the period of limitation in filing Appeal before the Sessions Court.

2) In view of withdrawal of the Appeal, nothing would survive in the Interim Application No. 3457/2024 and the same also stands disposed of.
