By this application, the applicant is seeking relaxation of condition No.(d) imposed by order dated 5th December 2024 passed by this Court (Coram : M. S. Karnik, J.) in aforesaid bail application. By the said condition, the applicant was directed to attend before the Investigating Officer of Kothrud Police Station, once in a month, on every first Monday between 11.00 a.m. and 01.00 p.m. and as and when called.

Learned counsel for the applicant submitted that the applicant is attending Court dates regularly and the matter is fixed for framing of charge, hence, the above condition be relaxed and the applicant be Digitally signed by SHUBHADA SHANKAR KADAM Date:

permitted to attend the police station as and when required. Learned counsel for the applicant further submitted that the passport of the applicant is in custody of the investigating officer. The applicant's visa is expiring in June 2025 and he needs to apply for fresh visa. Hence, he seeks permission for return of passport of the applicant and requested to allow the application.

Learned APP strongly objected to allow the application. 4.

I have heard both learned counsel.

Considering the submissions of both learned counsel as well as the fact that applicant is attending the court dates regularly and the matter is fixed for framing of charge as well as the applicant's visa is expiring in June 2025 and he needs to apply for fresh visa, I pass the following order :

O R D E R

(I) The bail condition mentioned in clause (d) of the order dated 5th December 2024 passed by this Court (Coram : M. S. Karnik, J.) is relaxed.

(ii) The applicant shall attend the concerned police station as and when required.

(iii) The Investigating Officer is directed to return the passport of the applicant in order to enable him to apply for visa. 2/3

(iv) The applicant shall not travel abroad without taking the permission of the Trial Court.

The interim application stands disposed of.
