By this application, the applicant is seeking relaxation of condition Nos.(c) and (f) imposed by order dated 25th October 2023 passed by this Court (Coram : M. S. Karnik, J.) in aforesaid bail application.

It is contention of learned counsel for the applicant that the applicant is directed to attend Kandivali Police Station, once in a month and not to enter the western suburbs of Mumbai except for attending the trial and for the purpose of reporting to the investigating officer. Learned counsel for the applicant further submitted that the applicant is attending Court dates regularly. The applicant's mother stays in Western Suburbs/Mumbai Suburban District and she requires assistance of the applicant. Hence, requested to allow the application. Learned APP strongly objected to allow the application on the ground that offence under Section 376 of the the Indian Penal Code 1860 is registered against the applicant. The victim stays in Mumbai Suburbs. If the condition is relaxed, the applicant may threaten the victim and prosecution witnesses , hence, requested to reject the application. 5.

I have heard both learned counsel.

The conditions were imposed in the year 2023. The applicant is attending court dates regularly. The applicant's mother is staying in Western Suburbs/Mumbai Suburban District. Considering these facts, I pass following order :

O R D E R

(I) The bail conditions mentioned in clauses (c) and (f) of the order dated 25th October 2023 passed by this Court (Coram : M. S. Karnik, J.) are relaxed.

(ii) The applicant shall attend the concerned police station as and when required.

(iii) The applicant shall not contact the victim or prosecution witnesses.

The interim application stands disposed of.
