The Applicant/Appellant was the accused in Special (S.C. & S.T.) Case No.6/2019 before the Special Judge at Gadhinglaj, Disrict-Kolhapur. The learned Judge, vide his judgment and order dated 6.5.2024, convicted the Deshmane(PS)

15-APEAL-ST-16663-24.odt Applicant/Appellant under Section 354 of IPC, Sections 3(1) (w)(i), 3(1)(w)(ii) & 3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. The major sentence imposed on him was RI for one year besides imposition of fine.

Learned counsel for the Appellant/Applicant submitted that he was on bail during the trial and even after his conviction he was granted temporary bail under Section 389 of Cr.P.C. There is delay of 10 days in filing the Appeal. 3.

Hence, the following order:

O R D E R

(i) Issue notice to the Respondent No.2, returnable on 16.10.2024. Till then, the order granting bail to the Applicant by the trial Court, shall continue. (ii) Stand over to 16.10.2024.
