The Applicant was the original accused in Sessions Case No.162/2021 before the Additional Sessions Judge, Nashik. The learned Judge, vide his judgment and order dated 30.1.2024, convicted him for commission of the offence punishable under Section 376(1) of IPC and sentenced him to suffer RI for ten years and to pay a fine of Rs.10,000/- and in default to suffer RI for six months. Heard Mr. Hrishikesh Chavan, learned counsel for the Applicant and Mr. Prashant Jadhav, learned APP for the Respondent-State.

Learned counsel for the Applicant submitted that the Applicant is in poor financial state. He could not afford to engage a private Advocate. He sought help from the Legal Services Authority of this Court. Therefore, some time was lost in collecting the papers, appointing an Advocate and filing the Appeal. Hence, there is delay of 74 days in filing the Appeal.

Considering these submissions and in the interest of justice, the delay of 74 days in filing the Appeal is condoned. The Appeal be processed further.
