The Applicant was the accused before the Additional Sessions Judge, Greater Mumbai in Sessions Case No.254/2022. The learned Judge, vide his judgment and order dated 27.2.2024, convicted the Applicant for commission of the offence punishable under Sections 398 and 506 of IPC. He was sentenced to suffer RI for seven PRADIPKUMAR PRAKASHRAO DESHMANE years.

Heard Mr. Vaibhav Ugle, learned appointed counsel for the Applicant and Smt. Sangita Shinde, learned APP for the Respondent-State.

Learned counsel for the Applicant submitted that the Applicant was in poor financial state and, therefore, he had written a letter to the Legal Services Authority of this Court to appoint an Advocate from their Panel. After that an Advocate was appointed. He collected the papers, prepared the Appeal and filed it. This has caused 101 days' delay. 4.
Considering this situation and in the interest of justice, the delay in filing the Appeal is condoned. The Appeal be processed further. The Application is disposed of accordingly.
