The applicant was convicted and sentenced by the learned Special Judge, Greater Bombay, in POCSO Special Case No.281 of 2019, under section 7 r/w. 8 of the Protection of Children from Sexual Offences Act, 2012 and under sections 342 and 354 of the I.P.C. The major sentence imposed on him was R.I. for three years besides imposition of fine. The said Judgment and order was passed on 15.05.2024.

Learned counsel for the Applicant submitted that the applicant was on bail during trial and after his conviction he was Digitally signed by VINOD BHASKAR GOKHALE Date:

1-ia-3635-24 granted bail U/s.389 of the Cr.p.c. for a temporary period of one month. He, therefore, submitted that the applicant be granted bail pending his Appeal.

Considering this submission, it is necessary to hear the Respondent No.2 since it is a conviction under the POCSO Act. 4.

Hence, the following order:

O R D E R

i) Issue Notice to the Respondent No.2, returnable on 08.10.2024.

ii) The Investigating officer shall inform the Respondent No.2 about the next date of listing and shall make a statement to that effect before the court on the next date.

iii) Till the next date, the order granting bail to the applicant U/s.389 of the Cr.p.c. passed by the trial Court is continued.

iv) Stand over to 08.10.2024.
