This is an application preferred by the original petitioner with a prayer to serve the Respondent No.1 through paper publication. Learned counsel submits and it is also mentioned in the application that, through various efforts the petitioner tried to serve the Respondent No.1. Even hamdast was taken, but the Respondent No.1 could not be served. The R.P.A.D. report mentions that the Respondent No.1 had refused the accept the service.

Considering these submissions and the efforts taken by the petitioner, I am satisfied that there is reason to believe that the Respondent No.1 is deliberately avoiding the service of this petition.

Therefore, the application is allowed. The Petitioner is permitted to effect the service through the newspaper publication by publishing the notice in the daily newspaper 'Pudhari (Kolhapur Edition)'; as prayed by the applicant/petitioner. 4.

The application is disposed of.

The Writ Petition be listed for further consideration on 22.11.2024.
