This is the third application preferred by the applicant seeking suspension of his sentence and enlargement on bail, pending the hearing and final disposal of the aforesaid appeal. It appears that the applicant's first interim application seeking bail, was withdrawn after arguing for some time, with liberty to file a fresh application for bail, if the appeal is not decided within one year from the date of the order. The same is recorded in the order dated 15th March 2022, N. S. Chitnis 1/2
26-ia.3648.2024.doc passed by this Court [Coram : S. S. Shinde (as he then was) & Sarang V. Kotwal, JJ.] in Interim Application No.270 of 2020. The said order is at Exhibit - 'C', on page 83 of the application. As far as the second interim application for bail preferred by the applicant is concerned, the prayer for bail was rejected by this Court [Coram : Nitin W. Sambre & R. N. Laddha, JJ.], by observing that as far as prayer for grant of bail in Interim Application No.3448 of 2021 is concerned, similar prayer made by the applicant vide Interim Application No.270 of 2020 was already not pressed and as such, no fresh grounds were made out in the said application. The said order is at Exhibit - 'D', on page 84 of the application.

Considering the aforesaid, judicial propriety requires that the present application be placed before a bench of which Hon'ble Shri Justice Sarang V. Kotwal, is a member.
