Heard learned counsel for the Applicant and learned APP for the State.

By this application, the Applicant is seeking modification of condition No.(c) imposed by this Court (Coram: M. S. Karnik, J.) vide order dated 5th September, 2023.

By the said order, this Court has imposed condition No.(c) that the Applicant shall attend the Investigating Officer of the Shantanu S. Dhudum 1/2 This order is corrected as per speaking to the minutes of the order dated 08/05/2025.

44-IA-3687-2024 IN BA-945-23 corrected.doc Mumbra police station twice a month evert alternate Monday of the month between 11:00 a.m. and 1:00 p.m. Learned counsel further submitted that the Applicant has attended the concerned police station regulalry, and he is a labourer and not in a position to take leave as it is not permitted to the Applicant where he is working. Hence, requested to allow the application.

Learned APP strongly objected to allow the application. 5.

Considering the submission of learned counsel for the Applicant and reasons mentioned in the application, the application is allowed. The Condition No.(c) imposed on the Applicant is modified as under, and I pass following order:-

ORDER

i. The Applicant shall attend the concerned police station as and when required by the Investigating Officer. 6.
