Interim Application (Stamp) No.3775 of 2024 is filed seeking condonation of delay of 204 days in filing the leave Application by which leave is sought for filing Appeal against the judgment and order dated 18 October 2023 acquitting Respondent No.1 in Sessions Case (POCSO) No.803 of 2021.

Records indicate that Respondent No.1 has been served with notice in Application. However, none appears on behalf of the Respondent No.1. Respondent No.2 is the first informant, who is personally present katkam Page No.

k 2/2 913 als st 18912.24 + ia as cri.doc before the Court and seeks appointment of Legal Aid Advocate. The High Court Legal Services Co-mmittee to provide Legal Aid Advocate to Respondent No.2.

Since Respondent No.2 supports the prosecution, it is not necessary to adjourn the hearing of the Interim Application for the response on part of Respondent No.2. None has appeared on behalf of Respondent No.1 for opposing the Application. 4.
Considering the averments made in the Application as well as length of delay, I am of the view that it would be appropriate to condone the delay in the interest of justice. Interim Application No.3775 of 2024 is accordingly allowed by condoning the delay in filing the Leave Application. Interim Application is accordingly disposed of. 5.
List Application for Leave to Appeal (State) No.18912 of 2024 for further consideration on 6 October 2025.
