Learned counsel for the Applicant, on instructions, submits that the Applicant has already suffered detention of 4 years and 6 months out of sentence of 10 years awarded. Faced with rejection of interim bail on 3 earlier occasions, the Applicant seeks leave to withdraw this application, however, makes a request that appeal itself may be taken up for final hearing.

Therefore, the application is dismissed as withdrawn. 3.

Liberty to the Applicant to move the Court, for request of hearing the appeal, after completing 50% of sentence period, under detention.

The Interim Application is disposed of.
