1) This is an application for condonation of delay in preferring the Appeal against the acquittal recorded by the Judgment and Order dated 19th June 2023, passed by the Learned Extra Jt. District & Addl. Sessions Judge, Panvel-Raigad, District Raigad in Special (POCSO) Case No.348 of 2020 (Old. Spl. (POCSO) Case No.30/2019). 28A. IA 3896-2024.doc 2) Learned A.P.P. for the Applicant-State, invited our attention to paragraph-2 of the Application. It is mentioned that the Judgment and Order was passed on 19th June 2023. After that, the certified copy was delivered on 12th December 2023. In the meantime, some time was lost in Mantralaya for taking a decision and then the matter was received in the Public Prosecutors' Office of this Court. Government Resolution was passed on 9th August 2024, for filing of the application for leave to appeal. Once the proposal was received in the Public Prosecutors' Office, the application for leave to appeal was filed on 5th September 2024.

3) Considering the submission and since the delay was not intentional, the delay of 178 days in filing the present application is condoned. The Interim Application is disposed of. (SANDESH D.
