DATED : 21st OCTOBER, 2024 P.C:- In compliance of the order dated 14/10/2024, Mr.Bobade, the counsel representing the applicant through Legal Aid, and we are informed that if the P.R bond fixed in the sum of Rs.25,000/- with one or more sureties in the like amount is reduced, and if he is released on his personal bond for a period of eight weeks, he shall furnish the sureties.

2/3 33.doc In the wake of the decision of the Apex Court in case of In-Re Policy Strategy for Grant of Bail dated 31/1/2023, where it is permissible to release an under-trial or convict on temporary bail for a specified period, so that he can furnish bail bonds or sureties, by virtue of direction no.(v) and since we have perused the report placed before us which have reflected difficulties in the way of the applicant in not complying with the condition stipulated in the order dated 2/12/2023 when he was directed to be released on bail, we direct that the applicant shall be released on temporary bail for a period of eight weeks, but this release shall be subject to the stipulation that he shall furnish the P.R. bond.

We also deem it appropriate to reduce the amount of P.R. bond as well as sureties to Rs.15,000/- from Rs.25,000/- looking to his financial condition. We direct the release of the applicant on temporary bail for a period of eight weeks so as to enable him to furnish the bail bonds of Rs.15,000/- along with one or two sureties in the like amount.

The applicant shall however report to the Chiplun police station on every Monday between 10.00 am to 12 noon till he ensure compliance of furnishing P.R bond and sureties. The applicant shall provide his current address, telephone number, place of residence and intimate about the change if any, to the concerned Investigating Officer.

3/3 33.doc We also however clarify that if the bail bonds are not furnished within the period stipulated, upon our attention being invited, the Court will take suo motu cognizance of the case and pass appropriate orders depriving him of his liberty. Interim Application stand disposed off.

This order shall be communicated to the concerned by Mr.Yagnik, the learned APP.
