Both the learned Advocates persuade to me to take the matter at the time of rising of the Court.

Heard Mr. Dave, learned Advocate for Applicant; Ms. Sayyad, learned Advocate for Intervenor and Ms. Yadav, learned APP for Respondent - State.

An order is passed in August, 2024 for deposit of an amount of Rs.10,00,000/-. Learned Advocate would submit that Applicant has deposited an amount of Rs.5,50,000/-, but due to certain exigency, he could not deposit the balance amount. He would submit that balance amount of Rs.4,50,000/- is available with him and now he is in a position to deposit. Let the said amount be deposited within a period of one week from today as directed by this Court. Registry to accept the same.

Liberty to the private Respondent to make appropriate Application for withdrawal of the entire amount which is deposited. 5.
Dispute between the parties is that an amount of Rs.15,00,000/- was received by the Applicant as against original documents which have been deposited with private Respondent. Case of private Respondent is that if he receives Rs.15,00,000/- he is ready and willing to hand over all the original documents to the Applicant. However, case of the Applicant is that he is agreeable to return back only Rs.10,00,000/- and not Rs.15,00,000/-.

Therefore this Court will hear the parties. It is open to the parties to reconcile their differences in the meanwhile without recourse to the Court.

Stand over to 20th January 2025.

In the meanwhile, ad-interim / interim relief granted earlier shall continue.
