This Petition is filed for quashing of the FIR registered vide C.R. No. 665 of 2023 registered at Kashimira Police Station for the offence punishable under Section 498A, 406, 323, 504, 506 read with Section 34 of the Indian Penal Code, 1860 (the IPC). Learned APP on instructions states that the investigation is over and the charge-sheet is ready. She seeks permission to file the charge-sheet before the Trial Court. Considering the statement, the Investigating Agency shall file the charge-sheet before the Learned JMFC, Thane on 14th October 2024 at 10.30 a.m. All the petitioners shall remain present before the Trial Court. Both the learned counsel for petitioners and the contesting respondent submitted that parties Purti Parab
2/2 3-WP-675-2024.doc are willing to explore the possibility of settlement through mediation. Learned counsel for petitioners submitted that Petitioner No.1 had job at South Africa and therefore there is urgency in the matter. Considering the situation, the following order.
ORDER
1. Both the parties shall appear before the Mediation Centre of this court on 15th October 2024 at 11.00 a.m.
2. The Officer in charge of the Mediation Centre shall immediately appoint a suitable available mediator to make an attempt to bring about the settlement between the parties through mediation.
3. Considering the urgency the process of mediation should not extend beyond 21st October 2024.
4. The final mediation report should be submitted before the court on or before 22nd October 2024. Till then no coercive steps shall be taken against the petitioners.
5. Stand over to 22nd October 2024.
