By this application applicant is seeking continuation of suspension of sentence and order passed by Special CBI Court in Special Case No. 93 of 2014 till disposal of the appeal. 2.

It is contention of learned counsel for the applicant that applicant has been convicted under Sections 406 and 420 of Indian Penal Code and under Sections 13(1)(d) and 13(2) of Prevention of Corruption Act, 1988. He has been sentenced to suffer rigorous imprisonment for one year and shall pay a fine of Rs. 1,000/- in default to undergo simple imprisonment for one month. Learned counsel further submitted that the trial Court has suspended the sentence by order dated 28th August 2024. The said order be continued.

Learned advocate for CBI strongly objected for continuation of the order.

I have heard both learned counsels.

Applicant has been awarded sentence of one year rigorous imprisonment. During the trial, he was on bail. The trial Court has suspended the sentence. Considering these facts, I pass following order:

ORDER

(I) Suspension order passed by the trial Court is continued till disposal of the appeal.

(II) The applicant shall inform to the Investigating Officer if he changes his address or mobile number.

(III) The applicant shall not leave India without prior permission of this Court.

The Interim Application is allowed in the aforesaid terms and is accordingly disposed of.
