By this Application, the Applicant is praying for relaxation of the bail condition No.(b) and (d) imposed by this Court (Coram: Madhav J. Jamdar, J.) by order dated 2nd February 2024. By said order this Court has imposed condition that, the Applicant shall not enter the Malegaon Taluka, District-Nashik, after being released on bail, except for reporting to the Investigating Officer, if called and for attending the trial. 2.
The learned counsel for the Applicant submits that, N.S. Kamble page 1 of 3
the Applicant's family is staying in Malegaon Taluka, DistrictNashik and he wants to stay with his family. The charge-sheet is filed. The charge has been framed against the Applicant. Hence, requested to allow the Application.

The learned APP for the Respondent-State strongly objected to allow the Application on the ground that, the Applicant has outraged the modesty of the victim and he stays near the victim's house. If he enters in the Malegaon City, he may threaten the prosecution witness and victim and requested to reject the Application.

I have heard both learned counsel. Perused order passed by this Court.

In the present case charge-sheet has been filed against the Applicant and charge is also framed against the Applicant. The Applicant stays in Malegaon City. He wants to stay with his family.

In view of above, I pass following order.
ORDER
(i) The Condition No.(b) and (d) imposed N.S. Kamble page 2 of 3
on the Applicant by this Court (Coram : Madhav J. Jamdar, J.) by order dated 2nd February 2024 is relaxed.
(ii) The Applicant shall attend Malegaon City Police Station once in three months, as per his convenience.
(iii) The Application is allowed in the aforesaid terms.
