Criminal Application No. 496 of 2022 was heard by the Court and notice was issued to the Respondents. Respondent No.2 is the estranged wife of Petitioner No.1. By an order dated 11th April, 2023, this Court granted ad-interim relief to the Petitioner. By an order dated 11th July, 2023, the Criminal Application was admitted and the interim relief was confirmed. On 4th September, 2024, since the learned Advocate for the Applicant was not present, the Criminal Application was dismissed for nonprosecution. 1/2

The present Interim Application has been filed within limitation, seeking recall of the order.

For the reasons set out, and keeping in view that the Interim Application was filed within limitation, this Interim Application is allowed. The order dated 4th September, 2024 stands recalled. Criminal Application No. 496 of 2022 is restored to the stage at which it was dismissed. 4.
