This is an application for restoration of Cr. Writ Petition No.3706/2021 which was dismissed for non-prosecution vide the order dated 4th September 2024. At that time nobody had appeared for the Petitioner. Similarly, nobody had appeared for the Respondent No.1 either.

Learned Counsel for the Petitioner submitted that the said matter was admitted vide the order dated 8th June 2023 and at that time by way of interim-relief stay was granted to the proceedings.

LSP 2 904 ia 4223.24.doc Learned Counsel submitted that when the matter reached for final hearing, the learned Counsel could not remain present due to inadvertence. Learned Counsel comes from Pune and on that particular day he was unable to come to Mumbai and was unable to make any alternate arrangement.

Considering these submissions and in the interest of justice, the following order is passed:-

ORDER

(i) Criminal Writ Petition No.3706/2021 is restored to its original file.

(ii) Interim Relief granted is also restored. (iii) The matter be listed for final hearing in due course. (iv) Interim Application is disposed of.
