I have heard Mr. Mundargi, learned Advocate for Applicant; Mr. Wanwari, learned Advocate for private Respondent and Ms. Krishnaiyer, learned APP for the State at the bar briefly. 2.

After going through the record of the case, without prejudice to the rights and contentions of both the parties before me, I am of the opinion that this is a fit case where if the parties can talk to each other, then a reconciliation may be possible. Needless to state that this opinion is expressed in view of the timeline in the present case which is argued by both the learned Advocates.

Interim Application states that hearing of the Criminal Revision Application on merits be expedited. One opportunity is given to the parties to attempt a reconciliation, considering that this is a Revision filed in a Section 138 case.

Original complainant has unfortunately expired in the interregnum and the prosecution is continued by his wife, who is 84 years old. Original Accused is a Private Limited Company, which according to the learned Advocate, is no more functional / operational Managing Director of the said Company who is also 77 years old and is bedridden with serious medical ailments.

However, without prejudice to the rights and contentions of both the parties, parties may be at liberty to approach each other. 6.

At the request of the parties, at present no order is passed in the Interim Application.
