Learned counsel for the Applicant submitted that he was continuously in custody from September 2021. He is from poor financial background. Therefore, he could not file this Appeal immediately. Hence there is delay in filing the Appeal. 5.

Learned APP does not have serious objection for condonation of delay.

Considering these submissions and in the interest of justice, the delay of 61 days in filing the Appeal is condoned. 7.

The Appeal be processed further.
