This Court by order dated 18.04.2023 in Bail Application No.3599 of 2022 while releasing the applicant on bail has inter alia imposed the following condition:

"(iii) The Applicant shall attend the concerned police station once in a month, i.e., on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial."

By this application, the applicant seeks relaxation of the aforesaid condition.

The learned counsel for the applicant submits that pursuant to the above condition, the applicant has attended the concerned police station till date. It is submitted that the applicant is the only earning member in his family. It is submitted that the applicant is resident of Nalasopar and to attend the police station at Panvel, Dinesh S. 18-ia-4497-24.doc he has to keep his shop closed for whole day. It is submitted that the condition in question be relaxed.

The learned APP for the respondent/State submits that considering the nature of offence, the condition in question was imposed.

Admittedly, there are no criminal antecedents against the applicant. Considering overall facts and circumstances, I am inclined to relax the condition in question. Hence, the condition inquestion is hereby relaxed 5.

Accordingly, the Application is disposed of.
