Heard learned counsel for the applicant.

By this application, the applicant seeks leave to file appeal against the acquittal order of respondent No.1 passed by Metropolitan Magistratre. Learned counsel for the applicant submits that he is suppose to file appeal before the learned Sessions Judge but inadvertently he has filed appeal before this Court.

Considering the submissions of learned counsel for the applicant, the instant application along with delay condonation application is allowed to be withdrawn with liberty to file appeal before learned Sessions Judge.

The delay caused in pursuing this application be condoned. 5.

Both the applications stand disposed of.
